Agreement and eligibility

In short: Using the site means you accept these terms, and you must be an adult to use it.

These Terms of Service are an agreement between you and Treomark ("Treomark," "we," "us") governing your use of the Treomark website and the features available on it. By accessing or using the site you accept these terms and our Privacy Policy. You must be at least 18 years old to use the site. If you use the site on behalf of a business, you represent that you are authorized to bind that business, and "you" includes it.

What Treomark is, and is not

In short: A comparison directory with sourced information. Not a clinic, not a referral service, not an endorsement.

Treomark is an information directory that publishes wellness-provider details together with a source-review status and the evidence behind each published fact. It is a comparison and discovery tool. Treomark is not a healthcare provider, clinic, pharmacy, laboratory, insurer, or medical service; it does not arrange, deliver, or supervise treatment; and it is not a referral service. A provider's presence on Treomark is not a recommendation or endorsement, and no payment by any provider can create one.

Not medical advice

In short: Nothing here is medical advice. Talk to a licensed clinician, and call 911 in an emergency.

Nothing on Treomark is medical advice, and using the site does not create a clinician-patient relationship. Information about services, including regulated medical and aesthetic services, is provided for comparison only. Always consult a licensed clinician about eligibility, risks, medications, and treatment decisions before receiving any regulated service. If you are experiencing a medical emergency, call 911 or your local emergency number immediately. Never delay seeking medical care because of something you read on this site.

What source review means

In short: A label about evidence at a point in time. Not a guarantee of quality, safety, or outcome.

A Source-reviewed label means a reviewer checked a specific claim against available evidence at a point in time. It is not a guarantee of quality, licensure, safety, availability, price, or outcome, and it is not an endorsement. Under review means a claim was submitted and is not yet confirmed. Self-reported means the provider supplied the information and it has not been independently checked. Regulated marks a medical or aesthetic service that carries a consultation requirement with a licensed clinician. Provider verification and source review are separate: a profile may be publicly sourced and unclaimed while individual facts still link to sources. Information can change after review; always confirm current details directly with the provider.

In short: Paid placement is always labeled and never changes a review status or ranking.

Any paid or sponsored placement on Treomark is clearly labeled as such. Sponsorship never implies source review, never changes a provider's source-review status, and does not affect ranking. Payment cannot buy a label.

Using the site

In short: Use it lawfully and honestly, and do not break or abuse it.

Automated access

In short: Good-faith crawlers that respect robots.txt are welcome. Abusive scraping is not.

Treomark publishes public pages and welcomes good-faith automated access, including search and AI crawlers, that identifies itself honestly, respects the directives in our robots.txt, and does not degrade the service. Automated access that ignores robots directives, evades rate or security controls, harvests personal information, submits forms, or extracts a substantial portion of the directory for republication or resale is prohibited.

Contact requests

In short: Contact forms ask a provider to reach you. Be accurate, and keep medical details out of them.

Where contact intake is enabled, submitting a request asks the selected provider to contact you; it does not book, reserve, or purchase anything. You agree to provide accurate contact details, to have the authority to consent to being contacted at them, and to keep medical and other sensitive information out of the form, as described in our Privacy Policy. Providers respond on their own schedule; Treomark does not guarantee a response.

Provider submissions and claims

In short: Submit accurate information and media you are allowed to share.

If you claim a profile or submit provider information, you represent that you are authorized to act for that business and that your submissions are accurate, not misleading, and supported by the sources you provide. You grant Treomark a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt for formatting, publish, and display your submissions in connection with operating and promoting the directory. Treomark may review, label, edit for presentation, decline to publish, or remove any information, and may approve or reject any claim request, at its discretion, including where content appears inaccurate, unsupported, unlawful, or unsafe. Provider-supplied content remains the responsibility of the provider that submitted it. Any paid provider feature, where offered, will carry its own clearly presented terms before purchase.

For uploaded photos and other media, you represent that you own the content or have permission to share it, that people shown have agreed to its use, and that it contains no patient or private health information. The license above includes resizing, cropping, converting, and displaying that media on Treomark profiles and in materials that promote those profiles.

Third-party sites and services

In short: Provider websites, phones, and booking systems are theirs, not ours.

Profiles link to provider websites, phone numbers, and booking routes, and pages may load content from third parties such as map imagery. Those sites and services are not operated by Treomark, and we are not responsible for their content, availability, bookings, pricing, or privacy practices. Your dealings with a provider, including any appointment, purchase, or treatment, are solely between you and that provider.

Intellectual property and feedback

In short: The site and directory are ours; your feedback can be used to improve it.

The Treomark name, logo, site design, software, and the selection, arrangement, and compilation of the directory are owned by Treomark and protected by law. We grant you a limited, revocable, non-exclusive license to access and use the site for personal, non-commercial comparison and discovery, and for providers, to manage their own presence. No other rights are granted. If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or obligation to you.

In short: Tell us if you believe something here infringes your rights, and we will review it.

If you believe content on Treomark infringes your copyright or other rights, contact us (see How to contact us) with the location of the content, a description of the claimed infringement, your contact information, and a statement that your complaint is made in good faith. We review such notices promptly and remove or restore content as the law requires.

Disclaimers

In short: The site is provided as is. Information can be incomplete or out of date. Confirm before acting.

The site and all content are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. Without limiting the foregoing, Treomark does not warrant that provider information is complete, current, or error-free; that any provider holds a particular license or delivers a particular standard of care; or that the site will be uninterrupted, timely, or secure. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.

Limitation of liability

In short: Our liability is limited to the extent the law allows. Decisions about care are yours and your clinician's.

To the maximum extent permitted by law: Treomark and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to your use of the site; and Treomark's total liability for all claims arising out of or relating to the site or these terms will not exceed the greater of one hundred US dollars ($100) or the amount you paid Treomark for the service giving rise to the claim in the twelve months before the claim arose. Treomark is not liable for the acts or omissions of any provider, or for decisions made based on information found on the site; you are responsible for verifying details with the provider and a licensed clinician. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these terms limits liability that cannot be limited by law.

Indemnification

In short: If your misuse or your submissions cause a claim against us, you cover it.

You agree to defend, indemnify, and hold harmless Treomark from claims, damages, and expenses, including reasonable attorneys' fees, arising out of your violation of these terms, your misuse of the site, or, for providers, the content you submit and your dealings with the people who contact you through the site.

Suspension and termination

In short: We can suspend abusive access or remove content; you can stop using the site at any time.

We may suspend or terminate access to the site, decline or revoke a profile claim, or remove content at any time, including where we reasonably believe these terms have been violated or the safety or integrity of the service is at risk. You may stop using the site at any time. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law, survive.

Governing law and venue

In short: Florida law, Florida courts.

These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these terms or the site that is not resolved informally will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction. Before filing a claim, you agree to contact us and give us thirty days to try to resolve the dispute informally.

Changes to these terms

In short: The date at the top reflects the current version; continued use means acceptance.

We may update these terms as the product and applicable requirements change. The date at the top reflects the most recent revision. Material changes will be visible on this page before they take effect, and your continued use of the site after a change takes effect constitutes acceptance of the revised terms.

Miscellaneous

In short: Standard housekeeping: severability, no waiver, assignment, entire agreement.

If any provision of these terms is found unenforceable, the remaining provisions stay in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. A failure to enforce a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These terms, together with the Privacy Policy, are the entire agreement between you and Treomark about the site and supersede prior agreements about it.
